TERMS AND CONDITIONS: ILLOVO SYRUP PROMOTION

  1. Definitions:

    Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

    1. Closing Date” means midnight on 31st of July 2025.
    2. Promotion” means the Illovo Syrup Promotion starting on 21 March 2025 (“Opening Date”) and ending at 31July 2025, (“Closing Date”) organized by the Promoter and open to all people residing in South Africa.
    3. Promotion Period” means the period between 21 March 2025 ending on 31st July 2025.
    4. Participant” means a person who enters the Promotion.
    5. Participating ProductsSKUS: Caramel, Golden, Traditional Syrup.
    6. Participating Stores” means any retailer of any one of all the Participating Products in the Republic of South Africa which is approved by the Promoter to participate in the Promotion.
    7. Promoter” a company duly incorporated in accordance with the company laws of the Republic of South Africa.
    8. Prize or Prizes” means:
      Week 1- 2 R10000 (entries 21st March till 31st March)
      Week 3 -8 R10000 (entries 1st April 25th till 30th April)
      Week 9- 12 R10000 (entries 1st May till 31st of May)
      Week 13 - 16 R10000 (entries 1st June till 30th of June)
      Week 17 - 20 R10000 (entries 1st July till 31s of July)
  2. Application of Terms and Conditions:

    By choosing to enter the Promotion, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.

  3. Entry Requirements:

    1. To be eligible for Participation in this Promotion the Participant must:
      1. Be a South African citizen or permanent resident over the age of 18 (eighteen) years old.
      2. Successfully enter the Promotion in accordance with the entry mechanism set out in clause 3.3; and
      3. Adhere to the terms and conditions that apply to this Promotion.
    2. Participants may only enter this Promotion in the Republic of South Africa.
    3. To enter the Promotion, Participants must:
      1. Purchase any of the Participating Products as set out in clause 1.5 above;

    4. Standard data rates will apply. Free minutes do not apply.
    5. Entries received through any medium other than the entry pathways stipulated in clause 3 shall not be considered.
    6. Restrictions on Entries
    7. No entries submitted on behalf of a third party will be accepted.
    8. Only entries received within the Promotion Period will be considered.
    9. A Participant will only be able to enter the competition once per day with each individual till slip showing a purchase of Participating Products and to a maximum of 5 entries over the whole Promotion Period.
    10. Participants must retain the till slip as proof of purchase and will be required to validate prizes. Only till slips that clearly show the purchase of Participating Products will be accepted. Participants may not enter the same till slip more than once and any duplicated entries will be disqualified.
  4. Prizes and Award Terms:

    1. Certain pre-determined entry positions will carry an automatic prize of R200 (two hundred) store vouchers that will be automatically awarded to the Participant upon valid till slip upload and verification. Winners will be selected using an independently audited and verified algorithm process. The algorithm will randomly determine whether an entry is a winner based on the total number of sales forecasts to be made during the promotional period.
    2. Every Participant that submits a valid and qualifying till slip and completes the journey will be entered into that week’s draw as set out in clause 4.3 below.
    3. The Prizes are as follows:
      Up to 2500 x R200 Shopping vouchers and “instant win” prizes are available to be won allocated randomly against position numbers.
      Up to 5 guaranteed winners of R10 000.00 (ten thousand) each will be randomly drawn during the Promotion Period from all qualifying entries. These winners will be drawn as follows:
      • Week 1- 2 R10000 (entries 21st March till 31st March)
      • Week 3 -8 R10000 (entries 1st April 25th till 30th April)
      • Week 9- 12 R10000 (entries 1st May till 31st of May)
      • Week 13 - 16 R10000 (entries 1st June till 30th of June)
      • Week 17 - 20 R10000 (entries 1st July till 31s of July)
      Every valid and qualifying till slip will be entered into that monthly prize draw.
      No alternatives will be offered.
      The prizes are not transferable.
      The prizes are subject to availability, and we reserve the right to substitute a prize with another prize of equivalent value without prior notice.
    4. If the weekly prize winners cannot be successfully contacted within 24 hours of the final decision or is unable, for any reason whatsoever, to accept the prize, a replacement winner will be randomly drawn from the remaining qualifying Participants in the draw in accordance with same process and procedures as applicable to the original draw.
    5. Any prize not taken up for any reason within two months of notification will be forfeited.
  5. Use of Personal Information:

    1. Personal information is information relating to a Participant. Personal information includes but not limited to a Participant’s identity number or passport number and contact details and any other details required in terms of this Promotion (“Personal Information”).
    2. The Personal Information may be collected by the Promoter or a third-party agency on the Promoter’s behalf. In the event that the information is being collected by a third-party agency, this information will be transferred to the Promoter and the Participant agrees and authorises the Promoter to use the Personal Information only for the purposes of this Promotion.
    3. As far as the law permits, each Participant agrees and gives the Promoter permission to collect, get, receive, record, organise, collate, store, update, use, and share all of his/her Personal Information for all purposes of this Promotion.
    4. A Participant may request that the Promoter at any time before the Closing Date to correct or confirm any Personal Information if it is wrong or out of date.
    5. Each Participant warrants that he/she has the authority to allow the Promoter to use his/her Personal Information for purposes of this Promotion.
    6. The Participant agrees that any photographs or videos taken of them in relation to this Promotion become the property of the Promoter, to use in any marketing campaigns as the Promoter deems fit. The Participant shall have no claim for any compensation for the use of the photographs or videos.
  6. Warranties and Indemnities:

    1. The Promoter, its employees, officers, directors, agents and associates and the Participating Stores, their employees, officers, directors, agents and associates (the “Indemnified Parties’’) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense, damage or penalty suffered or incurred by any person as a result of participating in the Promotion.
    2. All products given as part of the Prizes (if any) are subject to all applicable warranties, guarantees and instructions of use accompanying such products.
  7. Force Majeure:

    In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to the foregoing enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called "Force Majeure") then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.

  8. General:

    1. The Promoter may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on social media platforms
    2. The following persons may not enter the Promotion or be eligible to win any of the prizes:
      1. any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated to the Promoter.
      2. a supplier of Participating Products or services in connection with the Promotion.
    3. Prizes are not transferable for cash or any other prizes.
    4. The Promoter will not accept responsibility for entries that are lost, mislaid, damaged, undelivered, or delayed in transit, regardless of cause, including, but not limited to, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
    5. The Promoter reserves the right to disqualify any Participant who breaches any provision of these terms and conditions.
    6. In the event of a dispute regarding any aspect of the Promotion and/or these terms and conditions, the Promoter’s decision will be binding and final and no correspondence will be entered into.
    7. In the event of a dispute regarding a winner chosen in accordance with 4 above, the decision of an independent admitted attorney, independent accountant or agency duly appointed by the Promoter will be final and binding and no other correspondence will be entered into.
    8. The Promoter reserves the right to cancel, suspend, amend, or terminate the Promotion at any time and without notice to the Participants.
    9. Entry into this Promotion will be deemed as acceptance of these terms and conditions in its entirety and without any deviation.

    11. This Promotion shall be strictly subject to the Promoter’s Group Code of Conduct and Business Ethics and its Anti-Bribery and Corruption policies, copies of which will be made available on request.
    12. These terms and conditions of this Promotion is governed by the laws of the Republic of South Africa.
